2.HOLANGCOURS and EUDUC

HOLANGCOURS is a brand operated by Jimmy FELIX EI. Both names designate the same legal entity: commitments made under the HOLANGCOURS brand bind Jimmy FELIX EI.

HOLANGCOURS is the language teaching service of that ecosystem. EUDUC is its publisher, which is why that name appears on invoices, contractual documents and this page.

The site's technical infrastructure and data may be operated or stored by the host and its subcontractors under their contractual commitments and the applicable data protection rules.

4.Access to the site

The site is normally available at all times, subject to maintenance, updates, technical incidents, network interruptions or any other event beyond HOLANGCOURS's control.

HOLANGCOURS may temporarily suspend, limit or interrupt access to all or part of the site where this is necessary for maintenance, security, updating or proper operation.

The site is offered from various countries. This international availability does not mean that every course, service or payment method is available or marketed in every territory.

5.Intellectual property

Unless stated otherwise, the general structure of the site together with the texts, courses, videos, audio recordings, exercises, dictations, questionnaires, illustrations, graphic elements, photographs, downloadable documents, databases, distinctive signs, logos and other content appearing on it are the property of Jimmy FELIX EI, or are used with the permission of their respective holders.

These elements are protected in particular by the French Intellectual Property Code, international copyright conventions and, where applicable, foreign intellectual property legislation.

Browsing the site and purchasing a course transfer no intellectual property rights to the user. The user receives only a personal, limited, non-exclusive, non-assignable and non-transferable right of access and use, under the applicable contractual terms.

Unless previously authorised in writing or expressly permitted by law, it is prohibited to:

  • reproduce, copy, record, download or substantially represent the content;
  • distribute, share, resell, rent or make the content available to third parties;
  • modify, translate, adapt or create derivative works from the content;
  • disclose the credentials giving access to a course or a personal space;
  • extract or reuse a substantial part of the databases;
  • use the content for commercial purposes, to train third parties, or to feed an automated system without prior authorisation.

Short quotations and other uses permitted by law remain allowed, provided the author and source are clearly cited and normal exploitation of the content is not harmed.

Any unauthorised use may constitute infringement and engage its author's civil or criminal liability.

6.Personal data

HOLANGCOURS processes certain personal data, in particular when browsing the site, creating an account, purchasing a course, using teaching resources, taking an assessment, sending a message or subscribing to a communication.

The purposes of processing, their legal bases, the categories of data collected, their retention periods, their recipients, any international transfers and the rights of data subjects are set out in the Privacy policy.

Data subjects also have the right to lodge a complaint with the French data protection authority, the CNIL (www.cnil.fr), or with the competent supervisory authority of their place of residence where the rules so provide.

7.Cookies and other trackers

The site uses cookies or similar technologies necessary for its operation, in particular for authentication, the basket and security, as well as, subject to the user's consent where required, audience measurement or personalisation tools.

Users can obtain detailed information about the trackers used, change their choices or withdraw their consent at any time using the "Manage cookies" button at the foot of every page.

Refusing non-essential trackers does not prevent access to the site's essential features.

8.Accessibility and connection conditions

HOLANGCOURS serves learners who connect over slow or expensive networks, particularly in Haiti. The site is built to stay usable in those conditions: pages work without scripts, heavy content loads only on request, and courses remain readable on an older phone.

HOLANGCOURS strives to make its interfaces usable by as many people as possible, in particular with a keyboard and a screen reader, and to maintain sufficient contrast. This is an ongoing effort and does not, to date, constitute a declaration of conformity with an accessibility standard.

Any difficulty of access can be reported to infos@euduc.com. HOLANGCOURS endeavours to respond and, where possible, to offer a suitable solution.

9.Liability

HOLANGCOURS makes reasonable efforts to provide accurate, understandable and regularly updated information. However, the information available on the site is provided for information and teaching purposes and may need to be adapted to each user's particular situation.

Unless expressly stated, the teaching content does not constitute individualised legal, tax, accounting, financial, medical or professional advice. Users remain responsible for the use they make of the information, tools and resources provided.

HOLANGCOURS does not certify. It takes you to the level. HOLANGCOURS does not guarantee any particular professional, academic, linguistic, financial or commercial outcome. Results depend in particular on the user's own work, diligence, environment and personal circumstances.

HOLANGCOURS's liability cannot be excluded or limited where such exclusion or limitation is prohibited by a mandatory legal provision, in particular in the event of personal injury, gross negligence, wilful misconduct or breach of a consumer's legal rights.

10.Links and external services

The site may contain links to resources or services operated by third parties. HOLANGCOURS does not continuously monitor these external resources and cannot guarantee their availability, security or the accuracy of their content.

The presence of an external link does not necessarily constitute approval of, or a partnership with, the publisher of the site concerned.

Some teaching content may be delivered through an external video player. These players are called in enhanced privacy mode where their provider allows it; their use remains subject to that provider's terms.

Services available on HOLANGCOURS subdomains, as well as training spaces operated on behalf of client organisations, belong to the same ecosystem. Their use may be subject to additional specific terms, presented directly on the service concerned.

11.Spaces operated on behalf of organisations

HOLANGCOURS makes its software available to training providers, institutions and companies, which operate a space in their own colours and under their own name.

In those spaces, the organisation is its own publisher. The courses offered, the certificates issued, the prices charged and the documents given to its learners are its responsibility and not that of HOLANGCOURS.

The legal notice, terms of sale and privacy policy applicable in such a space are those of the organisation concerned, reachable at the foot of its pages.

12.Consumer mediation

As at the date this legal notice was last updated, the site is in a pre-launch phase and does not yet allow paid transactions with consumers.

Before online sales to consumers actually open, HOLANGCOURS will appoint a consumer mediator listed by the French commission for the evaluation and control of consumer mediation. The mediator's contact details and the procedure for referral will then be inserted into this legal notice and into the Terms of sale.

13.Governing law

The site and this legal notice are governed by French law.

Where the user acts as a consumer and resides in another country, the choice of French law does not deprive them of the mandatory protections they may enjoy under the law of their country of residence.

The rules on governing law, complaints and competent courts for purchases are set out in the Terms of sale.
